Private legal practitioner Martin Kpebu is calling for the immediate resignation of Special Prosecutor Kissi Agyebeng.

He says the conduct of the Special Prosecutor in the high-profile Ken Ofori-Atta case shows a failure of duty and a breach of public trust.

Speaking on Joy News’ PM Express on Wednesday, vociferous Kpebu said he had been invited by the Office of the Special Prosecutor (OSP) but stressed he was “not being investigated for any offence at all.”

He said the office only wanted him to clarify comments he had made, comments which he said were meant “to help the corruption fight.”

He then outlined the basis of his criticism.

According to him, “the most salient” point is that “by now, the Special Prosecutor himself should have resigned.”

He said the OSP had “finally come to confess… on November 5” that before former Finance Minister Ken Ofori-Atta travelled, “he, Kissi Agyebeng, intercepted the letter Mr Ofori-Atta wrote to both the incoming Chief of Staff and the outgoing ones.”

Kpebu said the Special Prosecutor admitted he intercepted the letter and then urgently sought support from security agencies.

“He said he intercepted the letter, then he ran to the National Investigations Bureau (NIB), but he didn’t get help, then ran to National Security, but didn’t get help there either, and finally he ran to the Ghana Immigration Service and still didn’t get help.”

He called it a major indictment of those institutions, but insisted the bigger failure was the Special Prosecutor’s own silence.

He said, “Worst of all, it didn’t occur to the man who had done the ‘Ankwanuma’ press conference that he should blow the whistle.”

He said the OSP should have “informed the people of Ghana through a press conference and say ‘Hey, people of Ghana, I’ve clear evidence Mr Ofori-Atta is about to travel out of Ghana and I’ve gone to these institutions, but they are not helping me.’”

Martin Kpebu argued that a public alert would have changed everything. “You know how many people would have taken steps to the airport to prevent him from travelling?” he asked.

He said he was at the time part of the ORAL team. He said the team “had security capos like Kofi Boakye” and others “in the back room” who could have acted if the information had been shared.

Mr Kpebu insists the failure to do so is enough reason for the Special Prosecutor to step down.
