The Court of Appeal has ordered a stay of proceedings in the criminal trial of former National Food Buffer Stock Company (NAFCO) Chief Executive Officer, Hanan Abdul-Wahab, pending the determination of an appeal challenging a High Court decision on the charges against him.
The order follows an application by Hanan’s legal team, led by former Attorney General Godfred Yeboah Dame, seeking to suspend the trial while the appellate court considers their challenge to the charges.
The defence is contesting a ruling by the trial judge, Justice Francis Achibonga, who in July 2026 ordered amendments to two charges relating to defrauding by false pretences but dismissed an application to strike out the charges entirely.
Lawyers for Hanan had argued that the charges did not contain sufficient particulars of the alleged offences.
After the High Court dismissed their application to suspend the trial pending the appeal, the defence renewed its request before the Court of Appeal.
Deputy Attorney General Dr Justice Srem-Sai represented the state in the proceedings.
The stay means the trial will remain on hold pending the determination of the substantive appeal challenging the High Court’s decision.
